Official Giveaway Rules - “Learn about RESPs and get a chance to win a bundle of prizes to set your child towards academic achievements”
Giveaway sponsored by Embark
1. “family.one” and “Embark” (Knowledge First Foundation and Knowledge First Financial Inc and Embark Student Corp., Embark Student Foundation) operate in accordance with compliance standards established by Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti Spam Laws (CASL).
2. This Giveaway is operated in accordance with the Competition Act and Enforcement Guidelines as published by Competition Bureau Canada.
- The terms Giveaway and Contest are interchangeable.
3. This Giveaway is designed to encourage:
a. Childhood literacy, and
b. Financial planning for post-secondary education through communication with Embark, Canada’s resource for education savings and planning (Registered Education Savings Plans) provider.
4. By entering this Giveaway:
a. I agree to receive Communications (emails, telephone calls, and physical mailings) from Embark regarding RESP product offers even if I have registered with Canada’s National Do Not Call List.
b. I consent to have family.one transfer my first name, last name, email address, full mailing address, telephone number(s), child’s date of birth and gender to Embark to facilitate communicating with me. family.one will ensure information is transferred securely to Embark.
c. I understand that Embark is a third-party and independent of family.one. family.one is not responsible for the activities of third-parties or unsubscribing from them. I can withdraw my consent to Communications with Embark or update my preferences recorded by Embark at any time only directly with Embark. I can review Embark’s Privacy Policy or contact Embark if I have questions.
5. To enter online: login at https://family.one, or via receipt of promotional electronic mail and click ‘ENTER’ where indicated.
6. Additional Entries: After entering the Giveaway, additional entries for the primary entrant can be obtained as follows: +1 entry point for each entry resulting from a social share, +2 entries points for each entry by a family member connected using the family share function, +1 entry point for each entry resulting from a social share by a family member connected by family share who does not qualify to enter the Giveaway themselves.
7. Giveaway is open to all residents of Canada (excluding residents of Quebec) who, as of the date of winner selection: (i) have reached the age of majority as of 24 January 2024; (ii) are members of family.one; (iii) are parents or grandparents of a nominated child under the age of 12 (twelve) years as of 24 January 2024; (iv)are not employees of family.one or the Giveaway sponsor, [Embark or their parent company], their respective advertising and promotional agencies, or any family member living with any such employee.
8. No purchase necessary. Entries must be received no later than 23:59PST on 24 January 2024. family.one is not responsible for entries that are lost, misdirected, misidentified, inaccurately captured, or have errors, or any negligence that may arise or occur in connection with the Giveaway. All entries become the property of family.one.
9. A separate random draw for each Prize will be made automatically through family.one’s systems according to the Winner Selection Dates below, from all eligible entries received. To win, selected entrant(s) must have previously correctly answered a skill-testing mathematical question.
10. When a winner claims the Prize, they consent to the use of their name and/or photograph, and/or place of residence, without further compensation, in any publicity carried out by family.one or the Giveaway sponsor in perpetuity and in any media worldwide.
11. By entering and/or by accepting a Prize, the winner (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Price as awarded; (iii) releases family.one and Embark., and their parent, affiliated and related companies, the Prize suppliers, Prize sponsors, and their respective officers, directors, employees and agents, including, without limitation, their advertising and promotional agencies and the independent Giveaway organizations (“Releasees”), from any and all liability, loss or damage incurred with respect to Giveaway entry, the awarding, receipt, possession and/or use or misuse of any Prize and acknowledge that the Releasees have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied in fact or in law, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
12. There is a Prize available to be won. The approximate retail value of Prize is listed below. Prize must be accepted as awarded, is non-transferable and no substitutions are permitted.

Value: The prize is estimated to be worth a minimum of $500 retail value [Canadian dollars].

Winner Selection Date: 19 September 2024 00:00PST
13. In the event that any selected entrant incorrectly answers the skill-testing question or is otherwise unwilling or unable to comply in full with these rules, a new entry will be drawn.
14. Selected winner(s) will be sent a system generated electronic notification at the email address noted in their family.one account, with details on how to claim their Prize. No correspondence will be entered into regarding redemption of the Giveaway Prize except with selected winning entrant. If the winner does not respond then s/he will be notified for the second time, 2 (two) days after the first notification. If the winner does not respond within 2 (two) days of the second notification, a third and final notification will be sent. If no response is received within 7 (seven) days of the initial correspondence, a new winner will be chosen in the same manner until a winner is successfully contacted.
15. The chances of winning a Prize will depend on the number of eligible entries received. Decisions of the judges in respect of all aspects of this Giveaway including, but not limited to, eligibility of entries and correctness of answers given to the skill-testing question, are final. Before being declared a confirmed winner, the potential winner may be required to complete a declaration and release form and confirm compliance with these Rules.
16. family.one and the Giveaway sponsor, and their respective agents are not liable to an entrant in any manner relating to the Giveaway or the awarding and use of the Prize.
17. This Giveaway is subject to all FEDERAL, PROVINCIAL, AND MUNICIPAL LAWS and regulations. The right is reserved by family.one to terminate this Giveaway, in whole or in part, and/or modify, amend or suspend the Giveaway, and/or these rules in any way (subject to applicable laws).
18. Collection of information: By entering, the entrant consents to the collection of all personal information included on their entry and agrees to the use and disclosure of such information by and between family.one and their agents and Giveaway sponsor. The winner also agrees to the collection, use and disclosure of their name, entry, photographs, voice and statements for family.one’s or the Giveaway sponsor’s publicity purposes without further compensation. All personal information collected by family.one will be kept in accordance with the privacy policy of family.one, which can be viewed at https://family.one, and in accordance with all applicable privacy laws for family.one and Embark.
19. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Giveaway related materials, including, but not limited to; the Giveaway entry form and/or point of sale, television, print or online advertising? the terms and conditions of these Rules shall prevail, govern and control. All issues and questions concerning the construction, validity, interpretation and unenforceability of these Rules or the rights and obligations of entrant and Sponsor in connection with the Giveaway shall be governed by and construed in accordance with the substantive laws of the Province of Ontario without regard to Ontario conflict of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
